Summary (English) |
Law 1166 of October 12, 1962 enacts the National Referendum Act. Aims to determine the procedures and methods of a national referendum on a proposed amendment to the Constitution to be conducted under Article 9 of the Act on Emergency Measures for National Reconstruction. Provides that this Act shall apply to the case of the fifth Amendment to the Constitution (December 17, 1962); sets up the Central Referendum Management Committee and referendum management committees of various levels as independent entities to take charge of matters related with a national referendum; stipulates that the date of a national referendum shall be publicly announced by the President fifteen days prior to the date of such referendum; provides that a voting slip shall have consent and dissent columns and the forms and standards thereof shall be set forth in an attached table; requires the Central Referendum Management Committee to tally and publicly announce the final results and make a report thereof to the chairman of the Supreme Council for National Reconstruction concurrently; stipulates that any voter dissenting to the effect of a national referendum may file a complaint to the Supreme Court with 20 days from the date of such referendum; provides that in case of invalidity decision, a referendum shall be held again on the condition that if it is possible to determine the result of such referendum without resorting to re-voting, the Central Referendum Management Committee shall make such decision; and authorizes the head of the Cabinet to order the dissolution of referendum management committees upon the completion of their duties.
