HISTORIC DOCUMENT: Constitution of Romania – as revised ("CONSTITUŢIA ROMÂNIEI din 1991"). The main revisions concern the right of the European Union (EU) citizens to elect and be elected to the local administration authorities after Romania's accession to the EU, the limitation of the preventive arrest to no more than 180 days, the right of Romanians to elect and be elected to the European Parliament. Other revisions stipulate that the arrest and search warrants shall be issued by the judge and not by the prosecutor, that private property is guaranteed and protected by the State regardless of the owner, that after Romania's accession to the EU foreigners and stateless persons may acquire property rights on land in Romania, that the State may be kept responsible for judicial errors and that military service shall cease to be compulsory. It also separates the powers of the two houses of the Parliament - the Senate and the Chamber of Deputies - and stipulates that ordinary bills have to be passed within 45 days, or within 60 days when it comes to codes or other bills of great complexity and if the said time limits are exceeded the bills in question are considered as being adopted. Further on it stipulates that the mandate of the President of Romania shall be of 5 instead of 4 years, that the President of Romania can not revoke the prime-minister, regulates in more clear terms the status of government emergency ordinances and grants to ethnic minorities the right to use their mother language, orally or in writing, before the local administration authorities and before the courts of law under certain conditions that shall be regulated by an organic law. Adds a new Title V1 – Euro-Atlantic integration – that creates the constitutional legal foundation for Romania's accession to the EU and NATO. The Constitution of Romania was first adopted by the Constituent Assembly in its meeting of 21/11/1991, was published in "Monitorul Oficial" of Romania, Part I, no.233 of 21/11/1991 and came into force following its approval by the national referendum that was held on 8 December 1991. This revised version of the Constitution of Romania came into force on 29/10/2003 – the day when the Law on the revision of the Constitution of Romania, as approved by national referendum on 18-19/10/2003, was published in "Monitorul Oficial" of Romania, Part I, no.758 of 29/10/2003.
