Summary
(English)
The Mass Labor Layoff Protection Law contains 21 articles and was promulgated by the President on 7 February 2003. The law is enacted with the goal of safeguarding labor's right to work and harmonizing employer's right to management, avoiding labor's rights being infringed or possibly being infringed as the result of laying off labors en masse by enterprises, and maintaining social stability. The essential points are:
1)That the central competent authority shall be the Council of Labor affairs of the Executive Yuan, and local competent authorities shall be the municipal government and county (city) government (Article 3)
2)To define the meaning of 'mass layoff', and to indicate the limitation on the duration, number and ratio of labors being laid off (Article 2)
3)That enterprises shall take some preliminary actions before intending to lay off labors en masse, such as informing local administrative agencies, submitting a layoff proposal and giving prior notice to labors (Article 4)
4)That the labor-management shall negotiate, based on the spirit of self-reliance, within ten days after the enterprise submintting the layoff proposal, and the labor authority shall, in case the labor-management refuse to negotiate or fail to reach agreement, summon both sides to organize a negotiation council in engaging the negotiation based on the layoff proposal, and timely putting forward an alternate proposal (Article 5)
5)That local labor authorities shall automatically convene a meeting, in dealing with mass layoff by an enterprise, at least once bi-weekly, of the labor-management negotiation commission, and provide employment services-related consultation for the meeting; to indicate organization and functions of this commission as well as effectiveness of agreement reached over the meeting (Article 6~8)
6)To provide safeguards to labors during the period of prior layoff notice (Article 10)
7)That enterprises shall preferentially hire mass layoff labors in event of re-hiring labors with closely related characteristics (Article 9)
8)That administrative agencies or personnel concerned shall inform the labor authority about some happenings of an enterprise hiring more than 30 labors (Article 11)
9)That the central labor authority shall budget for supplemental funds for litigation fees and living expenses as a result of unlawful mass layoff (Article 14)
10)That the central labor authority shall set up an evaluation council to gather and evaluate information involving causes of mass layoff by enterprises, and the result shall be served as the ground for drawing up the enterprise and employment policy (Article 15)
11)That the enterprise's chairman of the board or its actual responsible person shall be banned from leaving the country under certain circumstances, in case mass layoff place and pension, severance pay and wages in back pay (Article 12)
12)That enterprises shall not mass layoff by virtue of race, language, ideology, religion, political party, birth place, gender, appearance, mental and physical disability, age and serving on the labor union (Article 13)
13)To impose fines on enterprises for failing to submit the layoff proposal before the time limit to the labor authority, and administrative agencies or personnel concerned (Article 17)
14)To impose fines on enterprises for refusing to negotiate the layoff proposal with labors, refusing to assign negotiation representatives to the negotiation council, or failing to inform all labors electing their representatives, or refusing the employment services personnel to be stationed in the enterprise after forming the negotiation council, or randomly transferring or laying off employees during the prior notice period of mass layoff (Article 18)
15)To impose fines on an enterprise hiring over 30 labors, for failing to specify, or failing to provide balance sheet and related information after the labor authority having been informed of the enterprise¡¦s grave management troubles and coming to the enterprise for probing (Article 19)
16)That this law shall take effect three months later after the promulgation (Article 21)(21 provisions, p.1-6).

2003年2月7日總統公布制定大量解僱勞工保護法。其立法目的在保障勞工工作權及調和雇主經營權,避免因事業單位大量解僱勞工,致勞工權益受損害或有受損害之虞,並維護社會安定。要點如下:
1.明定中央及地方主管機關。(第3條)
2.明定大量解雇之定義。(第2條)
3.明定事業單位欲大量解雇之預告動作,對當地行政機關之通報、解雇計畫及預告員工。(第4條)
4.明定勞雇雙方應於事業單位依前條規定提出解僱計畫書之日起十日內,本於勞資自治精神進行協商。勞雇雙方拒絕協商或無法達成協議時,主管機關應於十日內召集勞雇雙方組成協商委員會,就解僱計畫書內容進行協商,並適時提出替代方案。(第5條)
5.明定主管機關應每二週主動召開勞資協商委員會並派員提供就業服務之相關諮商;並明定協商委員會之組織職掌及其會議協議之效力。(第6~8條)
6.明定預告期間員工工作權的保障。(第10條)
7.明定對於被解雇員工應優先雇用。(第9條)
8.明定僱用勞工三十人以上之事業單位,應向主管機關通報之情形。(第11條)
9.明定中央主管機關應編列專款預算,作為因違法大量解僱勞工所需訴訟及必要生活費用。(第14條)
10.明定中央主管機關應設置評估委員會,就事業單位大量解僱勞工原因進行資訊蒐集與評估,以作為產業及就業政策制訂之依據。(第15條)
11.明定事業單位於大量解僱勞工時,積欠勞工退休金、資遣費或工資之情形,中央主管機關得函請入出國管理機關禁止其董事長及實際負責人出國。(第12條)
12.明定事業單位大量解僱勞工時,不得以種族、語言、階級、思想、宗教、黨派、籍貫、性別、容貌、身心障礙、年齡及擔任工會職務為由解僱勞工。(第13條)
13.事業單位違反第四條第一項規定未於規定期限前將解僱計畫書通知主管機關及相關單位或人員者之處罰。(第17條)
14.事業單位違反規定拒絕進行協商或拒絕指派協商代表或未通知全體勞工推選勞方代表者,或拒絕就業服務人員進駐或在預告期間將員工任意調職或解僱者之處罰。(第18條)
15.事業單位違反規定拒絕提出說明或未提供財務報表及相關資料者之處罰。(第19條)
16.明定本法自公布日後三個月施行。(第21條)
