Summary
(English)
The National Classified Information Protection Law contains 41 articles and was promulgated by the President on 6 February 2003. The essential points are:
1) That this law is enacted with the goal of establishing a mechanism that shall protect national classified information. (article 1)
2)That this law aims to protect national classified information and exclude the protection of the classified information that shall be officially secret but not in connection with the national security or interest. (article 2)
3)That the national classified information shall be divided into three levels (article 4)
4)To set forth provisions governing approving and altering national classified information. (articles 7, 8, 9 and 10)
5)To set forth provisions governing maximum years for keeping national classified information and automatic declassification. (articles 11, 12 and 27)
6)To provide for measures to protect national classified information. (articles 13, 14, 15, 16, 17, 18, 19 and 20)
7)To set forth provisions governing providing national classified information. (articles 21, 22, 23 and 24)
8)That proceedings of a case involving national classified information being carried on by a court or prosecutor office shall be conducted in secrecy. (article 25)
9)To impose penalties for interfering with national classified information (article 32, 33, 34, 35, 36, 37 and 38)(41 provisions, p.77-82).
