Summary (English) |
The amendment of 11 June 2003 applies to the Military Trial Law and adds additional articles 112-1, 112-2 and 234-1, revises articles 29, 36, 59, 60, 61, 109, 133, 181, 206 and 238. The essential points are:
1)That a procedural decision that may be appealed to the supreme military court shall be the first trial decision made by the superior military court or its branches.(article 29) 2)That military courts at various level may, if necessary and within the jurisdiction, designate an appropriate site to hold a provisional court hearing.(article 36) 3)That a military court shall hand down a procedural decision to order a defendant to be released on bail, to entrust the defendant to a person , to order the defendant to reside in a designated place, to order confiscation of bail, or to allow a person to take back the bail posted for the defendant , and all these decisions along with detention of the defendant shall still being made by a second trial court, in case of files and evidences having been delivered to the third trial court for appellate review.(article 109) 4)That military prosecutors shall be authorized to appeal to the third trial.(article 181) 5)That Criminal Procedure Law's proceedings involving cases appealed to the third court trial shall be applicable to cases appealed to the supreme military court or superior military court.(article 206) 6)That the Ministry of National Defense shall set military prison's organization and number of personnel.(article 234-1) 7)That law enforcement officers may conduct search without search warrant in case of ab consent search.(article 112-1) 8)That military prosecutors or military police officers shall report the outcome of the search to the military court issuing the search warrant.(article 112-2) 9)That military judges shall show their IDs while carrying out duties.(article 61) 10)That military police shall immediately conduct investigation upon knowing suspicion of crimes, and report the investigation to a military prosecutor or an immediate superior officer; that they may seal off the scene of a crime for a timely inspection.(artcles 59 and 60) 11)That military prosecutors may order military police to conduct crime investigation, gather evidences and file reports (article 133) (13 provisions, p.3-6). |

2003年6月11日總統公布增訂軍事審判法第一百十二條之一、第一百十二條之二及第二百三十四條之一條文;並修正第二十九條、第三十六條、第五十九條至第六十一條、第一百零九條、第一百三十三條、第一百八十一條、第二百零六條及第二百三十八條條文。要旨如下:
1.明定不服高等軍事法院及其分院裁定,得向最高軍事法院抗告之案件,僅限於該院所為之初審裁定。(第29條) 2.各級軍事法庭開庭,必要時,得在管轄區域內指定適當地方臨時開庭。(第36條) 3.明定命具保、責付、限制住居、沒入保證金或退保之決定,由軍事法院以裁定之;案件在第三審上訴中,而卷宗及證物已送交該管法院者,關於羈押被告、延長羈押及其他各項處分,仍由第二審軍事法院為之。(第109條) 4.賦與軍事檢察官上訴第三審之權利。(第181條) 5.明定上訴最高法院或高等法院之案件,準用刑事訴訟法關於上訴第三審之規定。(第206條) 6.增訂軍事監獄之編裝、員額由國防部定之。(第234-1條) 7.經受搜索人出於自願性同意者,其搜索得不使用搜索票。(第112條之1) 8.執行搜索完畢後,聲請核發搜索票之人員,應將執行結果陳報核發搜索票之軍事法院。(第112條之2) 9.增訂軍事審判官於依法執行職務時,應出示指揮證。(第61條) 10.軍法警察,軍法檢察官知有犯罪嫌疑者,應即開始調查,並將調查之情形報告該管軍事檢察官、軍法檢察官或其直屬長官;實施犯罪調查有必要時,得封鎖犯罪現場,並為即時之勘察。(第59,60條) 11.軍事檢察官得限期命軍法警察官或軍法警察調查犯罪情形及蒐集證據。(第133條) |
