Summary (English) |
The Nuclear Reactor Facilities Control Law contains 44 articles and was promulgated by the President on 15 January 2003. The law was enacted with the goal of ensuring public safety. The essential points are:
1)To define terms used and indicate the competent authority under this law. 2)To provide for restrictions of selecting a nuclear reactor plant site; designation, procedure, expense incurred and control of restricted area and low population zone. 3)To indicate procedures regarding constructing nuclear facilities, requirements for operating nuclear reactor facilities after its completion, and provisions governing operation license. 4)To indicate that nuclear reactor facilities' design, construction and operation shall match requirements for safety design and quality assurance. 5)To provide for control of reactivating a nuclear reactor being ceased operation due to unit's refueling outage or reportable events. 6)To provide for restrictions of operating a nuclear reactor, requirements for issuing operator¡¦s license, taking charge of operator's health examination, and taking measures to deal with operator's grave misconducts, dereliction of duty, as well as physical or mental abnormality. 7)That the competent authority may demand information about construction or operation of nuclear reactor facilities from the owner for inspection or commission related organizations (institutions) to conduct inspection, and the owner shall not evade, obstruct or refuse. 8)To provide for control of nuclear reactor's import, export, relocation, facilities, license and disposal of rights being entitled by a license, as well as matters relevant to partial exemption from control. 9)To provide for nuclear reactor facilities' decommissioning procedures, formula, range, and control of the facilities during decommissioning period, as well as related control of radiation dosage limit at the plant site after decommissioning. 10)To concurrently impose criminal and administrative penalties on wrongdoers (44 provisions, p.14-23). |
