Public Law 106-168 (113 Stat. 1806-1821) was enacted to amend chapter 30 of title 39, United States Code, to prevent the mailing of certain deceptive matter relating to sweepstakes, skill contests, facsimile checks, administrative procedures, orders, and civil penalties relating to such deceptive mailing practices, and for other purposes.

Title I, “Deceptive Mail Prevention and Enforcement Act,” sets forth provisions regarding: (1) restrictions on mailings using misleading references to the United States Government; (2) restrictions on sweepstakes and deceptive mailings; (3) postal service orders to prohibit deceptive mailings; (4) temporary restraining orders for deceptive mailings; (5) civil penalties and costs; (6) administrative subpoenas; (7) requirements of promoters of skill contests or sweepstakes mailings; (8) state law not preempted; (9) technical and conforming amendments; and (10) the effective date.

Title II, “Federal Reserve Board Retirement Portability Act,” sets forth provisions regarding: (1) the portability of service credit; (2) certain transfers to be treated as a separation from service for purposes of the thrift savings plan; and (3) clarifying amendments.

Title III, “Amendment to the Federal Property and Administrative Services Act of 1949,” concerns the transfer of certain property to state and local governments. (Bill: S. 335)
