Law 1802 of August 3, 1966 enacts the Foreign Capital Inducement Act. Aims to make an effective inducement and protection and also a proper use and control of foreign capitals which contribute toward the independence of national economy and its healthy development and the improvement of balance of international payments. Defines "foreign capital" under this Act as the object for which foreign capital has been induced to acquire stocks or shares, technology, external payment methods, or capital goods induced by a technology introduction contract, a contract of loan in cash, or a capital goods inducement contract; requires any foreigner who intends to acquire stocks or shares of a Korean corporation or unincorporated private enterprise to get authorization from the Minister of Economy and Planning; requires a foreign investment company to register at the Ministry of Economy and Planning after delivering the object for its investment; and allows a foreign investor to transfer its dividend to a foreign country without restriction and to sell out its stocks or shares by reporting to the Minister of Economy and Planning, and provides the tax reduction and exemption in favor of foreign investors and requires, on the other hand, them to get permission from the Minister of Economy and Planning when they intend to use foreign capitals for any purpose beyond the scope authorized.
