Summary (English)	DECISION 29 OF 29 AUGUST 2002, ISSUED BY THE CRIMINAL CHAMBER OF THE SUPREME COURT OF JUSTICE OF NICARAGUA. This case relates to the Remedy of Cassation which was filed against the decision issued by the Criminal Chamber of the Court of Appeals for the South Atlantic, by means of which it upheld the decision issued by the District Judge of the Crime of that city, in which were dismissed definitely to the defendants by the crimes of swindle, robbery, fraud and stellionate. The Criminal Chamber of the Supreme Court after the analysis of evidence in this case, it issued its decision, decreeing: It annuls the decision issued by the Criminal Chamber of the Court of Appeals, with respect to crimes of swindle and fraud by which the defendants were acquitted and does not override the decision in relation to the definitive dismiss of the defendants by the crimes of robbery, stellionate and theft with breach of trust, which is confirmed. The Supreme Court considered that in this case both the Judge and the Court of Appeals did not apply the system of the sound critical for the assessment of the evidences, which establishes our Code of Criminal Procedure in article 251 in fine, on the contrary, they refused value to the oral evidences, documentary evidences, visual inspection and the defendant's own confession.
(Spanish)	SENTENCIA 29 DEL 29 DE AGOSTO DEL 2002, EMITIDA POR LA SALA PENAL DE LA CORTE SUPREMA DE JUSTICIA DE NICARAGUA. Este caso se refiere al Recurso de Casación que se interpuso en contra de la sentencia dictada por la Sala Penal del Tribunal de Apelaciones del Atlántico Sur, mediante la cual confirmó la sentencia emitida por el Juez de Distrito del Crimen de esa ciudad, en la cual se sobreseyó definitivamente a los procesados por los delitos de estafa, robo, defraudación y estelionato. La Sala Penal del Supremo Tribunal después del análisis de las diligencias de este caso, emitió su sentencia, decretando: Se casa la sentencia dictada por la Sala Penal del Tribunal de Apelaciones, en lo que respecta a los delitos de de estafa y defraudación, por lo que fueron absueltos los procesados y no se casa la sentencia en referencia al sobreseimiento definitivo de los procesados por los delitos de robo, estelionato y hurto con abuso de confianza, lo cual se confirma. El Supremo Tribunal consideró que en este caso tanto el Juez como el Tribunal de Apelaciones no aplicaron el sistema de la sana crítica para la valoración de las pruebas, el cual recoge nuestro Código de Procedimiento Penal en el artículo 251 in fine; por el contrario, le negaron valor a las pruebas testificales, documentales, inspección ocular y a la propia confesión del procesado.
