Summary (English) |
The Ryan White HIV/AIDS Treatment Modernization Act of 2006 (Public Law 109-415, 120 Stat. 2767-2820) amends title XXVI of the Public Health Service Act to revise and extend the program for providing life-saving care for those with HIV/AIDS. It is divided into 7 titles.
Title I, “Emergency Relief for Eligible Areas,” sets forth provisions regarding: (1) the amendment of provisions of title XXVI of the Public Health Service Act (popularly known as the Ryan White Care Act [RWCA]) concerning emergency relief grants for metropolitan areas to assist in delivering and enhancing HIV-related services; (2) the type and distribution of grants, formula grants, and supplemental grants; (3) the timeframe for obligation and expenditure of grant funds; (4) the use of emergency relief grant funds; (5) additional amendments; (6) a new program and transitional grants for certain areas ineligible; and (7) the authorization of appropriations. Title II, “Care Grants,” contains provisions regarding: (1) the general use of grants; (2) the AIDS Drug Assistance Program; (3) the distribution of funds; (4) additional amendments; (5) supplemental grants on basis of demonstrated need; (6) emerging communities; (7) the timeframe for the obligation and expenditure of grant funds; (8) the authorization of appropriations; (9) an early diagnosis grant program; and (10) certain partner notification programs. Title III, “Early Intervention Services,” sets forth provisions relating to: (1) the amendment of provisions relating to grants to public and nonprofit private entities to provide early intervention services; (2) eligible entities, preferences, planning and development grants; (3) the authorization of appropriations; (4) confidentiality and informed consent; (5) the provision of certain counseling services; and (6) general matters. Title IV, “Women, Infants, Children, and Youth,” sets forth provisions regarding: (1) women, infants, children, and youth; and (2) a General Accounting Office (GAO) report. Title V, “General provisions,” sets forth general provisions regarding: (1) coordination of the Secretary with various agencies for the planning, funding, and mplementation of Federal HIV programs; (2) audits; (3) a public health emergency; (4) the prohibition on the promotion of certain activities; (5) privacy protections; (6) a GAO report; (7) the Severity of Need Index; and (8) definitions. Title VI, “Demonstration and Training,” contains provisions relating to: (1) demonstration and training; (2) AIDS education and training centers; and (3) the codification of a minority AIDS initiative. Title VII, “Miscellaneous provisions,” requires HIV/AIDS counseling programs to provide information on the transmission and prevention of hepatitis A, B, and C.
