Law no.58 of 22 March 2006 to ratify the Agreement on cooperation between Romania and Eurojust, signed at Brussels on 2 December 2005, and for the regulation of certain measures relating to the representation of Romania at Eurojust during Romania’s pre-accession and post-accession periods (“Lege pentru ratificarea Acordului privind cooperarea dintre România şi Eurojust, semnat la Bruxelles la 2 decembrie 2005, şi pentru reglementarea unor măsuri referitoare la reprezentarea României la Eurojust, în perioada ce precedă aderării şi după data aderării la Uniunea Europeană”). The ratifying Law stipulates, among other things, that the President of Romania shall appoint the liaison magistrate at Eurojust at the suggestion of the justice minister. The magistrate in question is going to be selected by the justice minister from among the prosecutors experienced in the fight against serious forms of transnational organized criminality, of corruption and terrorism. After Romania joins the EU the President of Romania shall appoint the national member at Eurojust and a number of assistants thereto for a mandate of 3 years. Said appointments are going to be made in agreement with Council Decision 2002/187/JHA of 28 February 2002 setting up Eurojust with a view to reinforcing the fight against serious crime. The Agreement shall be valid until Romania joins the European Union following that afterwards shall be applicable the legislation of the EU in the matter. Texts included.
