Summary
(English)
The Native Peoples Basic Law contains 35 articles and was promulgated by the President on 5 February 2005. The law is enacted with the goals of safeguarding native peoples’ basic rights, facilitating the development and subsistence for native peoples, and establishing the coexistence and co-prosperity relationship among ethnic groups. The essential points are:
1) That the Executive Yuan shall set up a Promoting Committee in charge of reviewing and coordinating relevant matters specified under this law, and to provide for the matters relevant to members and organization of the Committee (Article 3)
2) That the government shall safeguard native peoples’ equal status and implement autonomy in pursuance of their will (Article 4)
3) That the State shall provide sufficient resources, and shall annually budget for assisting native peoples in developing their autonomy (Article 5)
4) That the Office of the President shall convene a consultation meeting for solving any dispute over autonomy between the government and native peoples (Article 6)
5) That the government shall safeguard native peoples’ right to education in pursuance of their will, and based on the spirit of diversity, equality and respect, (Article 7)
6) That local governments shall designate dedicated agencies or persons to deal with affairs involving native peoples (Article 8)
7) That the government shall designate a dedicated agency responsible for the development and research of native peoples’ languages, and shall create a system of certifying language skills (Article 9)
8) That the government shall preserve and protect native peoples’ culture, assist cultural enterprises, and cultivate professional specialists (Article 10)
9) That the government shall reinstate native peoples’ traditional names of tribes, mountains and rivers in pursuance of their will (Article 11)
10) That the government shall safeguard native peoples’ access to mass media, create a Foundation of Native Peoples’ Cultural Enterprises, and map out a mass media or institute dedicated to native peoples and their languages (Article 12)
11) That the government shall protect and facilitate the development of native peoples’ traditional biological diversity and intellectual innovation (Article 13)
12) That the government shall map out economic policy, give guidance about conservation and utilization of natural resources, and develop economic enterprises for native peoples in pursuance of their will and the characteristics of environment and resources (Article 14)
13) That the government shall budget for actively improving transportations, postal services, telecommunications, water resources and irrigation, tourism and other public works in native peoples habitation, and urge public utilities to accomplish this goal (Article 15)
14) That the government shall map out housing policy for native peoples, assist them in buying or leasing houses, and shall actively push forward with the plan for tribal renewal (Article 16)
15) That the government shall safeguard native peoples’ right to work (Article 17)
16) That the government shall create a Foundation of Comprehensive Development for Native Peoples to deal with economic development and to give guidance to enterprises (Article 18)
17) To provide for the nonprofit activities that may be carried out by native peoples in their habitation (Article 19)
18) That the government would acknowledge native peoples’ land and natural resources rights; that for the purposes of surveying and processing these lands, the government shall create a Committee to deal with this matter (Article 20)
19) That while engaging in land development and utilizing natural resources, environmental conservation and academic research on native peoples’ habitation, the government or individual shall consult with native peoples or seek their participation, and native peoples may share in the benefits; that native peoples shall be consulted in case of the government, laws and regulations place restrictions on utilization of their lands and natural resources. (Article 21)
20) That while creating a national park, national scenic area, forest area, ecological conservation area, recreational area and other resources administration agency in native peoples’ inhabitation, the government shall consult with native peoples and establish a mechanism for co-management (Article 22)
21) That the government shall respect native peoples’ rights to choose the way of living, custom, clothing, type of social economic structure, way of utilizing resources, mode involving land’s ownership, utilization and management (Article 23)
22) The government shall map out public health and medical policy for native peoples in pursuance with their characteristics, include their inhabitation in nationwide medical network, implement health care, establish an impeccable framework for long-term care, emergency relief and aftercare, and safeguard their health and safety on life (Article 24)
23) That the government shall establish a system for natural disasters prevention and recovery measures in the aftermath of disasters in native peoples’ inhabitation, and shall designate and create natural disasters’ preferential protection areas for safeguarding their safety on life and property (Article 25)
24) That the government shall actively deal with native peoples’ welfare, map out a framework for their social security, and shall especially safeguard the benefits of children, women and disabled people (Article 26)
25) That the government shall actively promote mutual savings and other cooperative businesses for native peoples, and shall give guidance to business administration, and may adopt tax incentive measures (Article 27)
26) That the government shall safeguard and assist native peoples living outside their inhabitation in their health, living standards, financing, education, employment, medical treatment and social adaptability (Article 28)
27) That for the purpose of safeguarding native peoples’ dignity and basic human rights, the government shall additionally include a chapter titled ‘safeguarding native peoples’ human rights’ in the bill of national human rights (Article 29)
28) That the government shall respect native peoples’ languages, traditional custom, culture and value judgment, and shall safeguard their legal rights while dealing with enactment of law, or carrying out proceedings involving judicial and administrative remedies, notarial acts and meditations, and an interpreter shall be provided to those who don’t understand Mandarin; that for the purpose of safeguarding their judicial rights, the government may create a native peoples courthouse or court (Article 30)
29) That the government shall not store hazardous substances in native peoples’ inhabitation against their will (Article 31)
30) That the government shall not forcibly relocate native peoples from their inhabitation, unless an imminent and apparent danger arises (Article 32)
31) That the government shall actively facilitate economic, social, political, cultural, religious, academic and ecological exchange and cooperation between native peoples and international native peoples or ethnic minorities (Article 33)
32) That the competent authority shall amend, enact or abolish relevant laws and regulations in accordance with the principles set forth under this law within 3 years after taking effect of this law. (Article 34)(35 provisions, p.43-48)

2005年2月5日總統公布制定原住民族基本法,其立法目的旨在保障原住民族基本權利,促進原住民族生存發展,建立共存共榮之族群關係。要點如下:
1. 明定推動委員會之設置、委員組成及組織。(第3條)
2. 明定政府應依原住民族意願,保障原住民族之平等地位及自主發展,實行原住民族自治。(第4條)
3. 明定國家提供充分資源,每年應寬列預算協助原住民族自治發展。(第5條)
4. 明定政府與原住民族自治間權限發生爭議時,由總統府召開協商會議決定之。(第6條)
5. 明定政府應依原住民族意願,本多元、平等、尊重之精神,保障原住民族教育之權利。(第7條)
6. 明定地方政府應設原住民族專責單位或置專人,辦理原住民族事務。(第8條)
7. 明定政府應設置原住民語言研究發展專責單位,並辦理族語能力檢證制度。(第9條)
8. 明定政府應保存與維護原住民族文化,並輔導文化產業及培育專業人才。(第10條)
9. 明定政府於原住民族地區,應依原住民族意願,回復原住民族部落及山川傳統名稱。(第11條)
10. 明定政府應保障原住民族傳播及媒體近用權,成立財團法人原住民族文化事業基金會,規劃辦理原住民族專屬及使用族語之傳播媒介與機構。(第12條)
11. 明定政府對原住民族傳統之生物多樣性知識及智慧創作,應予保護,並促進其發展。(第13條)
12. 明定政府應依原住民族意願及環境資源特性,策訂原住民族經濟政策,並輔導自然資源之保育及利用,發展其經濟產業。(第14條)
13. 明定政府應寬列預算並督促公用事業機構,積極改善原住民族地區之交通運輸、郵政、電信、水利、觀光及其他公共工程。(第15條)
14. 明定政府應策訂原住民族住宅政策,輔導原住民建購或租用住宅,並積極推動部落更新計畫方案。(第16條)
15. 明定政府應保障原住民族工作權。(第17條)
16. 明定政府應設原住民族綜合發展基金,辦理原住民族經濟發展業務及輔導事業機構。(第18條)
17. 明列原住民得在原住民族地區從事之非營利行為。(第19條)
18. 明定政府承認原住民族土地及自然資源權利。政府為辦理原住民族土地之調查及處理,應設置原住民族土地調查及處理委員會。(第20條)
19. 明定政府或私人於原住民族土地內從事土地開發、資源利用、生態保育及學術研究,應諮詢並取得原住民族同意或參與,原住民得分享相關利益。政府或法令限制原住民族利用原住民族之土地及自然資源時,應與原住民族或原住民諮商,並取得其同意。(第21條)
20. 明定政府於原住民族地區劃設國家公園、國家級風景特定區、林業區、生態保育區、遊樂區及其他資源治理機關時,應徵得當地原住民族同意,並與原住民族建立共同管理機制。(第22條)
21. 明定政府應尊重原住民族選擇生活方式、習俗、服飾、社會經濟組織型態、資源利用方式、土地擁有利用與管理模式之權利。(第23條)
22. 明定政府應依原住民族特性,策訂原住民族公共衛生及醫療政策,將原住民族地區納入全國醫療網,辦理原住民族健康照顧,建立完善之長期照護、緊急救護及後送體系,保障原住民健康及生命安全。(第24條)
23. 明定政府應建立原住民族地區天然災害防護及善後制度,並劃設天然災害防護優先區,保障原住民族生命財產安全。(第25條)
24. 明定政府應積極辦理原住民族社會福利事項,規劃建立原住民族社會安全體系,並特別保障原住民兒童、老人、婦女及身心障礙者之相關權益。(第26條)
25. 明定政府應積極推行原住民族儲蓄互助及其他合作事業,輔導其經營管理,並得予以賦稅之優惠措施。(第27條)
26. 明定政府對於居住原住民族地區外之原住民,應對其健康、安居、融資、就學、就養、就業、就醫及社會適應等事項給予保障及協助。(第28條)
27. 明定政府為保障原住民族尊嚴及基本人權,應於國家人權法案增訂原住民族人權保障專章。(第29條)
28. 明定政府處理原住民族事務、制定法律或實施司法與行政救濟程序、公證、調解、仲裁或類似程序,應尊重原住民族之族語、傳統習俗、文化及價值觀,保障其合法權益,原住民有不諳國語者,應由通曉其族語之人為傳譯。政府為保障原住民族之司法權益,得設置原住民族法院或法庭。(第30條)
29. 明定政府不得違反原住民族意願,在原住民族地區內存放有害物質。(第31條)
30. 明定政府除因立即而明顯危險外,不得強行將原住民遷出其土地區域。(第32條)
31. 明定政府應積極促進原住民族與國際原住民族及少數民族在經濟、社會、政治、文化、宗教、學術及生態環境等事項之交流與合作。(第33條)
32. 明定主管機關應於本法施行後三年內,依本法之原則修正、制定或廢止相關法令。(第34條)
