The National Intelligence Services Law contains 33 articles and was promulgated by the President on 5 February 2005. The essential points are:
1) To define the ‘intelligence agency’, ‘intelligence services’, ‘person assisting intelligence services ’, ‘ intelligence agent’ and ‘information’ (Article 3)
2) That national intelligence services shall be overseen by the Legislative Yuan (Article 4)
3) That an intelligence agency shall form a mechanism for monitoring agency’s operation (Article 5)
4) To set guidelines for carrying out intelligence services, and to provide for the activities that shall not be engaged by an intelligence agency or agent (Article 6)
5) To provide for the scope of information that shall be gathered, analyzed, processed and exploited, and the methods of gathering information (Article 7)
6) That intelligence sources, channels or organizations, and the information about the identity, action of, or communication safety control over intelligence agents or persons assisting intelligence services shall not be disclosed, delivered, peeked, collected, destroyed, damaged or concealed, and to impose penalties for a violation (Articles 8 and 30)
7) That an intelligence agency may, due to the need for carrying out intelligence services, take under cover measures, and may set up under cover business, legal entity, or groups (Articles 9 through 12)
8) That government agencies at various levels shall, within the necessary scope of protecting the interest of national security, collaborate and assist in carrying out intelligence services (Article 13)
9) To provide for the competent authority’s functions and duties (Articles 14 through 20)
10) That the safety of intelligence agents or persons assisting intelligence services shall be safeguarded; to rescue intelligence agents or persons assisting intelligence services from loss of freedom as a result of carrying out intelligence services and to provide payment of indemnity, and to safeguard their rights and benefits (Articles 21 through 26)
11) To reward those who have made outstanding contribution to intelligence services (Article 27)
12) That intelligence agencies shall conduct periodic or random security check on subordinate intelligence agents (Article 28)
13) That penalties may be mitigated or exempted, in the case of an intelligence agent or person assisting intelligence services who has mismanaged intelligence services by taking orders from a superior, and would afterward tip off about the wrongdoings, or would honestly testify against any wrongdoing (Article 29)
14) To impose penalties on an intelligence agent or person assisting intelligence work for spying for a foreign state, or the enemy forces; for committing offenses by taking advantage of carrying out official duties. (Articles 31 and 32)(33 provisions, p.3-10)
