Summary
(English)
The Witness Protection Law contains 23 articles and was promulgated by the President on 9 February 2000. The law is enacted with the goal of protecting a witness who is willing to testify in a criminal case and a case of crackdown on vagrants, so as to speed up investigation and trial of crimes, or to establish a vagrancy case and carry on a trial, and to safeguard a defendant's rights and interests. The essential points are:
1)To define the meaning of 'criminal offenses' as referred under this law. (Article 2)
2)To provide for the type of witness eligible for protection under this law, and the means of providing protection to a witness. (Articles 3 and 4)
3)To provide for the matters regarding issuing writ of protection and related provisions. (Articles (Articles 5 through 13)
4)To specify that a defendant or suspect who has committed the criminal offenses as set forth under article 2, and has given testimony to a fact closely related a particular case, or has testified against other accomplices during the investigative proceedings, whose penalties shall be reduced or exempted. (Article 14)
5)That the provisions regarding the witness protection shall be applicable to an informant, complainant or victim. (Articles 15)
6)To impose penalties on a government employee or non-government employee for disclosing a confidential witness's information. (Article 16)
7)To impose penalties on someone who has been restricted to approaching a witness and knowingly violates the restrictions as set forth under paragraph 2 of article 12. (Article 17)
8)That someone who, for the purpose of obstructing or revenging a witness who gives testimony has committed offenses against a witness, the penalties shall be increased up to 1/2. (Article 18)
9)That a protected witness shall be deemed as having committed the offense of perjury if making false statements to a government official in charge. (Article 19)
10)To specify that a trial court may decide to administer a closed hearing, if probability of endangering a witness's life, body or freedom arises. (Article 20)
11)To specify that provisions of this law shall be applicable to cases involving a military court or prosecutor (Article 21)(23 provisions, p.22-27)

2000年2月9日總統公布制定證人保護法。本法之立法目的乃為保護刑事案件及檢肅流氓案件之證人,使其勇於出面作證,以利犯罪之偵查、審判,或流氓之認定、審理,並維護被告或被移送人之權益。要點如下:
1.明定本法所稱「刑事案件」之定義。(第2條)
2.明定本法依本法保護之證人之種類及提供保護之方式。(第3,4條)
3.明定核發證人保護書之事項及相關規定。(第5~13條)
4.明定依本法第二條所列刑事案件之被告或犯罪嫌疑人,於偵查中供查與該案案情有重要關係之待證事項或其他共犯之犯罪事證,就其因供查所及犯罪,減輕或免除其刑。(第14條)
5.檢舉人、告發人、告訴人或被害人有保護必要時,準用保護證人之規定。(第15條)
6.明定公務員或非公務員洩漏依本法應受身份保密證人之資料之處罰規定。(第16條)
7.明定對於受禁止或限制之人故意違反第12條第2項之規定者之處罰。(第17條)
8.明定對於意圖妨害或報復依本法保護之證人到場作證,而對受保護人實施犯罪行為,依其所犯之罪,加重其刑至二分之一。(第18條)
9.明定依本法受保護之人,於案情有重要關係之事項,向該管公務員為虛偽陳述者,以偽證論。(第19條)
10.明定對於訴訟之辯論,有危害證人生命、身體或自由之虞者,法院得決定不公開。(第20條)
11.明定本法之規定,準用於軍事法院及軍事檢察官受理之案件。(第21條)
